Confirm the period and the relevant rules
ATO implementation material identifies IIR and domestic minimum tax starting for years beginning on or after 1 January 2024, with UTPR starting from 1 January 2025. Map those dates to the group’s actual fiscal year, including a substituted accounting period where relevant. Do not assume the Australian subsidiary’s ordinary income-tax timetable answers the minimum-tax timetable. Establish which entities and local filings need attention, who is preparing them and what data the central group will supply. Keep the applicable law and current ATO instructions with the reporting calendar rather than relying on a generic international deadline.
Reconcile central and local assumptions
For a fictional foreign-headed group, headquarters prepares a GIR while an Australian company assumes the work includes every Australian submission. Ask what local returns or notifications remain required and whether central filing relief applies to the relevant obligation. Confirm entity names, periods, currencies and elections across the two workstreams. An overseas parent’s relief claim also needs to be distinguished from Australian domestic-tax analysis. Agree a process for revised figures so a change to the group calculation triggers the necessary local review instead of leaving inconsistent versions in separate advisers’ files.
Recognise that penalties have different bases
Australian minimum-tax administration interacts with the existing tax administration framework. Schedule 1, section 284-90(1C) of the Taxation Administration Act doubles relevant statement-related base penalty amounts for group entities of applicable MNE groups where they arise in relation to Australian IIR/UTPR or DMT tax. This is not a rule doubling every kind of penalty. Do not import an ordinary small-business penalty estimate without reviewing the minimum-tax provisions and any current administrative relief. A late document, an incorrect statement and an unpaid tax amount are different issues. Have the local adviser identify the relevant statutory route and circumstances before quantifying exposure. Preserve the group’s compliance steps and communications rather than assuming the complexity of new rules is itself sufficient protection.
Give the local process a clear owner
Maintain one list covering central data delivery, local review, approval, submission evidence and payment authority. Escalate missing data while there is still time to obtain advice or address a deadline issue. Keep a named person monitoring ATO correspondence and a documented handover when staff change. Bring us the structure, fiscal-year dates and current adviser scopes if the central and Australian teams are making different assumptions. We can help coordinate the interfaces with your Australian tax advisers. The goal is a traceable compliance process that connects the global analysis to the duties the local entity actually has.
What to do with this
- Map Australian commencement rules to the group’s actual fiscal year.
- Verify which local obligations survive central filing arrangements.
- Obtain specific penalty advice and retain evidence of compliance measures.
